Agreement to These Terms

This website is operated by Sway Realty LLC, doing business as Sway Vacation Rental Management ("Sway," "we," "us," or "our"). By accessing or using swayvrm.com and any of its pages (the "Site"), you agree to these Terms of Use. If you do not agree, please do not use the Site.

Sway Realty LLC is a licensed Arizona real estate broker.

What this Site is for

The Site provides information about our short-term rental management services for property owners, and information for guests staying at properties we manage. It allows you to contact us, request information, and submit an inquiry about your property.

Using the Site or submitting a form does not create a client relationship, an agency relationship, or a management agreement between you and Sway. A management relationship begins only when both parties sign a written property management agreement.

Revenue projections and estimates

We may provide revenue projections, income estimates, occupancy figures, or comparable property data at your request or as part of an inquiry.

These are estimates only. They are not a guarantee, promise, or warranty of future performance or income.

Projections are based on historical market data, comparable properties, and assumptions that may not hold true for your property. Actual results vary and are affected by factors outside our control, including seasonality, local regulation, market conditions, property condition, guest demand, competition, and platform policies. You should not rely on any projection as the sole basis for a purchase, financing, or investment decision.

No professional advice

Content on the Site is general information only. It is not legal, tax, accounting, insurance, or investment advice, and it is not a substitute for advice from a qualified professional who knows your circumstances. Short-term rental rules, licensing requirements, and tax obligations change and vary by city, county, and state. You are responsible for confirming what applies to your property.

Accuracy of information

We make a reasonable effort to keep the Site accurate and current, but we do not warrant that all content is complete, accurate, or up to date. Property descriptions, photographs, amenities, availability, rates, and service details are subject to change without notice. Photographs are representative and may not depict a specific property offered to you.

Your submissions

When you submit a form, you agree that the information you provide is accurate and that you are the property owner or are authorized to act on the owner's behalf.

By submitting your contact information, you agree that we may contact you by phone, email, or text message about your inquiry. Our handling of the information you submit is described in our Privacy Policy. Text messaging is also governed by our SMS Terms.

Do not submit confidential or sensitive information through the Site.

Acceptable use

You agree not to:

All content on the Site, including text, photographs, graphics, logos, and design, is owned by Sway or its licensors and is protected by copyright, trademark, and other laws. The Sway name and logo are our trademarks. Nothing on the Site grants you a license to use them.

You may view and print Site content for your own personal, non-commercial use.

The Site may link to third-party websites and services, including booking platforms, mapping services, and analytics providers. We do not control those sites and are not responsible for their content, accuracy, or privacy practices. A link is not an endorsement.

Availability

Disclaimer of warranties

Indemnification

You agree to indemnify and hold harmless Sway Realty LLC and its members, officers, employees, and agents from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your use of the Site, your submissions, or your violation of these terms.

Governing law and venue

These terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Any dispute arising out of or relating to these terms or the Site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.

Changes to these terms

We may update these terms at any time. The updated version takes effect when posted, and the "Last updated" date above will change. Your continued use of the Site after an update means you accept the revised terms.
